Removal Proceedings or Deportation and Exclusion Proceedings

On April 1, 1997 Deportation Proceedings and Exclusion Proceedings were replaced by removal proceedings. The procedures in deportation and exclusion proceedings are generally similar to the procedures in removal proceedings. However, it is important to understand that deportation and exclusion proceedings are significantly different from removal proceedings in areas such as burden of proof, forms of relief available, and custody. There are certain cases where an immigration judge may still be conducting deportation and exclusion proceedings that began before April 1, 1997. Accordingly, it is important if you are either in immigration removal or deportation and exclusion proceedings that you hire an immigration attorney to carefully review the facts of your case in conjunction with the laws and regulations pertaining to those proceedings. Attorney Christopher S.
